Estate Planning – It’s More Than Just a Good Idea, It’s Peace of Mind

You love your family, and you have worked hard to provide for them. They are your legacy. Estate planning protects your legacy. It’s an essential aspect of financial management that involves making arrangements for managing and distributing an individual's assets in the event of incapacitation or death, and, more importantly, making sure that minor children or incapacitated adult children, are cared for in the future. At Silver Bass & Brams in West Palm Beach, FL, we understand that nothing is more important than protecting your legacy – your family and assets. We can provide you with the guidance and tools to make informed decisions to protect your loved ones.

Guardianships & Wills

One crucial aspect of estate planning is establishing guardianships for minor children. We can help you put the proper plan in place to insure your children, or an incapacitated adult child, is cared for, both temporarily and permanently, by the people you choose – rather than by state authorities. Additionally, we can help you draft a set of estate planning documents that makes sure your wishes are honored.

Setting Up Trusts

Trusts are another critical aspect of estate planning. Most people will not be impacted by estate taxes. But everyone who has lost a loved one has a “probate nightmare” story. Probate costs can have tremendous negative financial and mental health costs on your loved ones. Probate can take a long time to complete. A will, by itself, will not avoid the financial burden and time required for the probate process. However, trusts CAN!!!! A trust can avoid probate costs and the time required for probate, and protect your assets. Our team can help you establish a trust and ensure that your assets are transferred to your beneficiaries according to your wishes and without the unnecessary costs and wasted time of probate.

Power of Attorney

At Silver, Bass & Brams, we can help you with different styles of Powers of Attorney to protect your interests in case you become incapacitated and unable to make decisions. A Power of Attorney is a legal document that grants someone else the authority to act on your behalf. There are two main types of Powers of Attorney: General and Limited. A General Power of Attorney grants broad powers to the agent, allowing them to act on your behalf in almost any situation. In contrast, a Limited Power of Attorney is more specific and only grants authority for certain tasks or situations.

Two types of Powers of Attorney come into effect only if you become incapacitated: Durable and Springing. A Durable Power of Attorney grants authority to the agent even if you become incapacitated, while a Springing Power of Attorney only occurs once you become incapacitated.

Choosing the correct type of Power of Attorney for your situation and choosing someone you trust as your agent is important. Our experienced attorneys can help you navigate the different types of Powers of Attorney and select the one that best suits your needs. We are dedicated to helping our clients protect their interests and ensuring that their wishes are fulfilled, even if they cannot make decisions themselves.
